Writing a Persuasive Prehearing Memo for Paralegals and Legal Advocates (9-24-20)

We will cover structure, format and timing of a prehearing memo. We will also talk about how to present uncomplicated theories of the case and helpful legal authorities and how to use SSA’s particular vocabulary effectively. We will include pointers on how to shift from the recitation of the facts to specific legal arguments. Finally, we will discuss special issues, including PTSD issues, DAA arguments, noncompliance issues, and work-related issues.

About the Faculty

    Melissa Zeidler (Speaker)

    Melissa Zeidler started her career at Nassau Suffolk Law Services representing people with cancer before a variety of legal and administrative tribunals, including the Social Security Administration. She then joined the Urban Justice Center's Mental Health Project, representing claimants at their Social Security administrative hearings and in federal court. In 2016, she attended the NY State Court of Appeals Chief Judge's Hearing on Civil Legal Services with a former client to provide invitation-only testimony on the impact of free civil legal services in our communities. She is currently the Director of the Disability Advocacy Project at Brooklyn Legal Services. She obtained a BA in Psychology from Binghamton University and a JD from Penn State's Dickinson School of Law. She is admitted in New York State, and the Eastern and Southern Districts of New York. Melissa has represented numerous claimants in their social security appeals, including successful oral argument in the Southern District of New York.
